ARBITRATION AWARD

Excellent Nhlapo Applicant

And

Gauteng Department of Education Respondent

DETAILS OF THE HEARING AND REPRESENTATION

  1. The hearing was held virtually on the 29 October 2025.
  2. Mr. Excellent Nhlapo, represented himself as the Applicant, while Mr. Matoditodi Modise represented Respondent.
  3. Both parties did not submit any bundles of documents.

THE ISSUE IN DISPUTE

  1. The Applicant referred a dispute for non-payment of salary. It was common cause that the Respondent owed the Applicant a salary for period 15 to 31 May 2025.I must determine the value of the salary for the period 15 to 31 May 2025, and order the appropriate claim or relief.

BACKGROUND TO THE DISPUTE

  1. The Applicant worked for the Respondent from 15 May 2025 until his dismissal sometime in September 2025.

SUMMARY OF EVIDENCE ON BEHALF OF THE APPLICANT

Mr. Excellent Nhlapo

  1. Mr. Nhlapo Moleke testified under oath, that he was appointed as educator by the Respondent from the 15 May 2025. He testified that he provided his services as an educator from the 15 May 2025 until his dismissal in September 2025.
  2. He testified that despite having tendered his services for the month of May 2025, he was never paid his salary.

SUMMARY OF EVIDENCE ON BEHALF OF THE RESPONDENT

Ms. T. Xawuka

  1. The Respondent’s first and only witness, Ms. Xawuka testified under oath. She confirmed the Applicant’s claim for the outstanding salary for May 2025. She further undertook to make calculations and submissions to the Respondent for payment of same.
  2. I have since received confirmation of the calculations for the Applicant’s claim, which is the sum of R 17 357.52.
  3. In the circumstances, I make the following award.

AWARD

  1. The Respondent, the Gauteng Department of Education, is hereby ordered to pay the Applicant, Mr. Excellent Nhlapo, an outstanding salary of R17 357.52 for the outstanding salary of May 2025.
  2. The payment in paragraph 11 above must be paid to the Applicant on or before the 15 December 2025.
